Terms of Service
The terms that apply when you use FlyingCarVideo.
Last updated: 2026-10-19
1. Agreement and operator
These Terms of Service govern your access to and use of FlyingCarVideo, including its website, accounts, video-generation tools, purchased video credits, and related support (the Service). “FlyingCarVideo,” “we,” “us,” and “our” refer to the independent operator of the Service under the FlyingCarVideo name.
By creating an account, purchasing credits, or using the Service, you agree to these Terms and our Privacy Policy and Refund Policy. If you do not agree, do not use the Service.
2. Eligibility and accounts
You must be at least 18 years old and legally able to enter into this agreement. The Service is not offered to minors, including with permission from a parent or legal guardian.
Provide accurate account information, keep your credentials secure, and promptly tell us about suspected unauthorized access. You are responsible for activity performed through your account unless applicable law provides otherwise.
3. What the Service does
FlyingCarVideo is an online AI video-generation service. You select a platform-provided motion-reference template and upload a car photo. The Service uses that photo, the selected template, and a built-in prompt to request a short AI-generated flying-car-style video. Current generation uses MiniMax H3, and completed media is delivered online for preview and download.
The Service, available models, video duration, resolution, templates, retry behavior, and other features may change as the product develops. We may modify, pause, or discontinue a feature where reasonably necessary, including for safety, legal, technical, or supplier reasons.
4. One-time video credits and payment
FlyingCarVideo sells video-generation credits as one-time purchases. These purchases are not subscriptions, do not automatically renew, and do not create recurring charges. Each accepted generation request consumes the number of credits shown before generation. The price, currency, included credits, and any taxes are shown at checkout and form part of your order.
Payments are processed by Waffo Pancake. We do not store your full payment-card number. Your payment may also be subject to the payment processor's terms and privacy practices.
Purchased credits:
- have no cash value and cannot be transferred or resold;
- do not have a fixed expiration date under the current product rules;
- remain subject to these Terms, including action required for fraud, chargebacks, unlawful use, or termination of the Service; and
- may be adjusted only to correct an error, process a refund, or enforce these Terms and applicable law.
Refund eligibility and processing are described in our Refund Policy.
5. Your photos, instructions, and rights
You retain whatever rights you lawfully hold in the photo and other material you upload (User Content). You must own the User Content or have all permissions required to upload it, process it with AI, and use the resulting video. Do not upload confidential material or content that infringes privacy, publicity, intellectual-property, contractual, or other rights.
You grant us a limited, non-exclusive, worldwide license to host, copy, transmit, transform, and otherwise process User Content only as needed to operate, secure, troubleshoot, and support the Service. This includes sending the necessary inputs to MiniMax H3 and storing inputs and outputs with Cloudflare services. The license ends when the content is deleted from our active systems, except for limited copies retained for security, legal, backup, or dispute purposes.
Subject to applicable law and third-party rights, you may use a generated video for lawful personal or commercial purposes. AI output may not qualify for copyright protection in every jurisdiction, and we do not transfer any rights in the Service, its software, or the underlying motion-reference assets. You remain responsible for determining whether your intended use is lawful.
6. AI output and reference-template limitations
AI-generated results are probabilistic. A result may differ from the preview or reference, misrepresent details, contain artifacts, or fail to preserve the exact appearance, color, geometry, badges, wheels, surroundings, or motion of the uploaded vehicle. We do not guarantee that every request will complete, that an output will be unique, or that it will be suitable for a particular purpose.
Motion-reference templates are provided to guide generation. Access to a template does not give you ownership of, or permission to download, redistribute, extract, or separately reuse, its source media, prompt, or other protected elements.
Review every generated video before publishing or relying on it. Clearly identify synthetic or altered media when required by law or platform rules. Do not present an output as authentic footage of an event that did not occur.
7. Acceptable use
You must not use the Service to:
- break the law, facilitate fraud, deceive others, or misrepresent synthetic media as verified evidence;
- infringe intellectual-property, privacy, publicity, or other rights;
- impersonate a person or organization, create harmful deepfakes, harass, defame, exploit, or endanger anyone;
- generate sexual exploitation material, content involving abuse of minors, extremist content, malware, or instructions for serious wrongdoing;
- bypass access controls, probe or disrupt the Service, automate abusive requests, or interfere with other users;
- resell accounts or credits, reverse engineer protected portions of the Service, or extract reference media or prompts except where applicable law expressly allows it; or
- upload content containing malicious code or excessive personal, confidential, or regulated information.
We may reject content, limit generation, suspend access, or preserve and disclose relevant records when reasonably necessary to enforce these Terms, protect users and the Service, or comply with law.
8. Third-party services
The Service depends on third parties, including Waffo Pancake for payment processing, MiniMax H3 for AI generation, and Cloudflare R2, D1, network, and security services for storage and operation. Third-party outages, policy changes, or processing delays may affect availability. We are not responsible for third-party services outside our reasonable control, but we will apply the refund and credit-restoration rules described in our policies.
9. Independent product and trademarks
FlyingCarVideo is an independent product. It is not affiliated with, sponsored by, endorsed by, or officially connected to Tesla or any other vehicle manufacturer. Vehicle names, logos, and trademarks belong to their respective owners. References to a vehicle or visual style are descriptive and do not imply sponsorship.
10. Service ownership
Except for User Content and third-party materials, the Service, its software, design, branding, and original materials are owned by or licensed to FlyingCarVideo and are protected by applicable intellectual-property laws. No rights are granted except the limited right to use the Service under these Terms.
11. Suspension and termination
You may stop using the Service at any time. You may request account or personal-data deletion by contacting us, subject to records we must retain for payment, security, dispute, or legal purposes.
We may suspend or terminate access if we reasonably believe you violated these Terms, created risk or harm, used the Service fraudulently, initiated an abusive chargeback, or if continued operation is unlawful or technically impracticable. Where appropriate, we will provide notice and a reasonable opportunity to address the issue.
12. Disclaimers
To the maximum extent permitted by law, the Service is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.
Generated videos are creative AI outputs, not professional, technical, safety, historical, or factual advice. You are solely responsible for reviewing and using them.
13. Limitation of liability
To the maximum extent permitted by law, FlyingCarVideo will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or opportunities arising from the Service. Our total liability for a claim relating to the Service will not exceed the amount you paid to FlyingCarVideo for the order giving rise to the claim during the twelve months before the event.
These limits do not apply where prohibited by law, including liability that cannot be excluded or limited under applicable consumer law.
14. Changes and disputes
We may update these Terms to reflect changes to the Service, suppliers, law, or risk. We will post the revised date and provide additional notice where required. Changes apply prospectively unless law requires otherwise.
Before starting formal proceedings, please contact us so we can try to resolve the issue. These Terms are governed by the laws that apply to the relationship and transaction without removing any mandatory consumer protection available to you. Disputes may be brought before a court or authority with jurisdiction under applicable law.
